Generally, it’s somebody when later in
life they’ve made a significant change
to their estate plan, whether it’s a
will or trust, or maybe it’s just um
executing a deed, uh like a quick claim
deed, giving their home or another
property to somebody. And then also
beneficiary designations. And
beneficiary designations are kind of a
big deal right now because you can now
do that online. So if it’s online, the
person doing it is not going into that
uh financial institutions’s office.
They’re not meeting with somebody, you
know, having a witness there to see that
they’re making this change. Somebody
else could make make that change by just
logging in as them on the computer. So
the litigation arises out of somebody
generally later in life making a change
um to their estate plan, beneficiary
designation or a deed. And then that
will result in litigation and that then
you deal with by virtue of an undue
influence or lack of testimentary
capacity.
