probably the most memorable trucking
00:06
crash case we’ve handled was a case
00:09
where my individual client was a member
00:11
of a motorcycle club
00:13
they had ridden down from maryland to
00:14
north carolina they’ve taken a break
00:17
they’re on a grass median on the side of
00:20
the road
00:20
ready to turn near greensboro north
00:24
carolina
00:25
a truck came down the highway the driver
00:27
of the truck had fallen asleep
00:29
he missed the curve he went off the road
00:32
and he wiped out the entire motorcycle
00:34
club
00:34
12 members or more of that motorcycle
00:37
club
00:37
had catastrophic tragic injuries there’s
00:40
some deaths
00:41
there were losses of limbs my client had
00:44
just tremendous injuries
00:46
as well and the biggest problem was that
00:49
we’re told in the beginning there’s only
00:50
a million dollars in coverage
00:52
by that truck to cover all of the
00:55
injuries
00:55
from all of the individual people that
00:58
had their life just wiped out
01:00
you just can’t accept that sometimes you
01:02
as a lawyer you have to keep digging and
01:04
digging and digging
01:05
and instead of dividing up that million
01:07
dollars 12 different ways between people
01:10
who have had deaths people have lost
01:12
limbs
01:13
you got to keep digging we were able to
01:15
dig and dig
01:16
and finally found insurance through the
01:19
insurance
01:19
broker who put that trip together they
01:22
picked up yogurt up in new england we’re
01:25
bringing it down south
01:26
and we’re able to get in and get
01:28
coverage through the broker because we
01:31
could prove that the broker knew
01:33
that there were problems with this
01:34
individual truck driver
01:36
their problems with the individual truck
01:37
that was used and we were able to get a
01:40
negligence claim against the broker and
01:42
find
01:42
millions of dollars in additional
01:44
coverage that
01:46
changed completely the dollars that my
01:49
client
01:50
was going to accept for a settlement
01:53
because he wasn’t just splitting the
01:54
million dollars 12 different ways before

Baltimore, MD personal injury lawyer Rick Jaklitsch tells the story of a memorable trucking accident case he handled. He recalls one of the most memorable trucking crash cases the firm has handled, involving a client who was a member of a motorcycle club. The group had ridden from Maryland to North Carolina and had stopped on a grass median near Greensboro. A truck driver, who had fallen asleep, missed a curve, went off the road, and wiped out the entire motorcycle club. Twelve or more members suffered catastrophic injuries, including fatalities and limb losses, while his client sustained tremendous injuries as well.
The initial challenge was that the truck had only $1 million in coverage to address all of the victims’ losses. He knew that dividing such limited coverage among people with life-altering injuries was unacceptable. Determined to secure fair compensation, he continued digging and ultimately identified additional insurance through the broker who had arranged the shipment. By proving that the broker was aware of issues with the truck driver and the vehicle, he was able to pursue a negligence claim against the broker and uncover millions of dollars in additional coverage.
This discovery dramatically changed the settlement for his client, ensuring that compensation was no longer limited to splitting $1 million among twelve severely injured individuals.
