a memorable
toxic tort case that i remember working
on is what we call the banana worker
case it’s basically
workers in central and south america
that have been exposed to toxic
chemicals uh while you know working in
the banana fields uh dbcp it’s a
fumozone it’s uh something that’s used
to get rid of nematodes that
you know adversely affect the banana uh
trees these workers uh that had applied
it and a lot of them did it in a very in
a very rudimentary and manual way so
were exposed to this chemical uh without
their knowledge really of of the
seriousness of the impact that it could
have on them
as a result of using this
pesticide it uh you know create
sterility
or low motility uh of the sperm and in
these men that were working in these
banana fields and so while i was working
there um on these cases during the
settlement we were hoping to get at
their their first generation of these
cases i went out and interviewed a lot
of the clients and went and found them
where they were in their town because a
lot of them couldn’t uh really travel to
san jose to the main city in costa rica
so we went out looking for them so we
could interview them and talk to them
about their cases
and you know i was really touched at
uh hearing their stories they they were
really
eloquent and
and in talking about how
really they had no idea of of what was
being you know what they were being
exposed to and yet they were working for
these companies and doing their jobs and
yet they didn’t know that they were not
being warned about these issues that uh
could have been prevented if they had
provided more protection for the workers
so it was just really heartbreaking to
hear their stories about you know even
sometimes having to drink water that was
running alongside the groves because
they’re washing their hands you know
before they ate and just rinsing their
hands not knowing that you know the
water was full of these chemicals that
was really poisoning them that was a big
learning experience for me again it was
earlier on in my career and yet we’re
still working with these some of these
same workers because
we’re still involved in litigation
against these companies chemical
companies five or six of them uh trying
to represent these uh workers so that
they can you know get some justice and
some compensation for their injuries
the case is set for trial soon and i’m
hopeful that we’re going to be able to
deliver the justice
and compensation that these workers
deserve

Austin, TX personal injury attorney Lulu Flores tells the story of a memorable toxic chemical case she handled. She recalls a particularly memorable toxic tort case known as the “banana worker” case. It involved workers in Central and South America who had been exposed to toxic chemicals while working in banana fields. The chemical, DBCP, a fumigant used to eliminate nematodes that harm banana trees, was applied in a rudimentary, manual manner, leaving workers unknowingly exposed to its serious effects.

The exposure resulted in sterility or reduced sperm motility among many of the men working in these fields. During the settlement phase of the first generation of cases, she traveled to meet clients in their towns, as many could not travel to San José, Costa Rica, the main city. She conducted interviews to understand their experiences and discuss the details of their cases.

She was deeply moved by their stories. The workers had no knowledge of the dangers they were facing and had not been warned or protected by the companies for which they worked. She was struck by accounts of men drinking water contaminated with chemicals simply to rinse their hands before eating—small daily acts that unknowingly exposed them to harm.

The experience was a profound learning opportunity early in her career. She continues to represent some of these workers, pursuing litigation against five or six chemical companies to secure justice and compensation for their injuries. The case is set for trial soon, and she remains hopeful that it will deliver the justice these workers rightfully deserve.
