so I think in recent years we’ve seen a
trend towards diversion programs
especially in Northern Virginia in terms
of property Crim so as opposed to just
trying to slap a conviction and and
punish someone we see the courts trying
to help people and trying to create
programs that get people the resources
that they need to make sure that
recidivism doesn’t occur and we don’t
continue to see this on the other hand
we sometimes see these crimes sort of
unfairly labeled and so you know someone
who who perhaps um goes and steals baby
food is viewed differently from someone
who goes and steals jewelry and so you
know just on the face these crimes are
sort of put into piles and our goal is
to make sure that a prosecutor or a
judge or a jury whoever is is looking at
this sort of case sees the complete
picture and doesn’t just sort of see the
the cover page of the case

Manassas, VA criminal defense attorney Lili R. O’Connell talks about the challenges faced in defending property crimes in VA based on trends in the prosecution. She observes that in recent years there has been a trend toward diversion programs, particularly in Northern Virginia, for property crimes. Rather than immediately pursuing convictions and punitive measures, courts are increasingly focused on providing individuals with the resources they need to prevent recidivism and address underlying issues.

She notes, however, that property crimes are sometimes unfairly categorized. For example, stealing baby food may be perceived differently than stealing jewelry, even though both are technically theft. Her approach is to ensure that prosecutors, judges, and juries see the full context of a case, rather than making judgments based solely on surface-level impressions.
