Alexandria, VA criminal defense attorney Chris Leibig talks about the trends he sees in the prosecution of sex crimes. He discuses that sexual offense cases have always presented unique challenges due to the inherent bias and stigma associated with such allegations. Prosecutors, investigators, judges, and juries often approach these cases with heightened caution, making every ruling and decision more difficult than in even violent crime cases, such as shootings.
He notes, however, that false allegations are not uncommon. Many individuals accused of sexual offenses never face charges because investigations reveal insufficient or unreliable evidence. Experienced defense attorneys frequently encounter clients whose cases never proceed for this reason.
Regarding recent trends, he observes that over the past five years there has been a pronounced societal and judicial shift toward believing victims, influenced in part by movements such as Me Too. While this trend has important social and cultural benefits, in the context of criminal defense it can create additional challenges. Jurors may feel pressure from public sentiment and political messaging, making it more difficult to acquit even when the evidence supports a defense. He emphasizes that this dynamic is a significant consideration in contemporary sexual offense cases.
