Westchester, NY family law attorney Andrea B. Friedman talks about equitable distribution. She states that equitable distribution is New York State’s framework for dividing property during a divorce. Under this law, all assets acquired during the marriage are subject to equitable distribution. Importantly, “equitable” does not mean “equal”—assets are not automatically split 50/50. Instead, the approach treats the marriage as an economic partnership, evaluating both direct and indirect contributions of each spouse. For each asset, the analysis considers not only its value but also the reasons behind that value and the role each spouse played in creating or supporting it. These factors can influence the percentage of the asset to which each spouse may ultimately be entitled at the conclusion of the case.
