my approach to dividing assets is to do
so to try to do so in kind for example
you wouldn’t mix uh retirement funds
with getting money out of a house or
something like that you want to look at
the tax implications of assigning Assets
in any funds any kind of equities stocks
bonds things like that I try to do those
in kind so that each of the parties I
would instruct the wealth advisor or
manager to um divide them equally so
each party has the same cost basis and
the same um assets Holdings in the end
you want this to be equal and so in real
estate you often um if someone’s going
to be keeping real estate um you then
would offset cash for that if you can uh
because that’s you know if you sold the
house you’d be getting cash so it’s
important to understand all the tax
implications of the different assets and
what each part is going to be left with

Boston, MA family law attorney Terri Partridge talks how stocks, bonds, and real estate get divided in a MA divorce. She approaches the division of assets with a commitment to achieving equitable distribution, carefully considering the unique characteristics of each asset. Her strategy involves allocating assets in kind, avoiding the commingling of disparate assets, such as retirement funds and home proceeds. A crucial element of her approach is the thorough assessment of tax implications related to the assignment of various assets, encompassing equity, stocks, and bonds.

For financial instruments like stocks and bonds, she guides the wealth advisor or manager to ensure an equal division, maintaining identical cost basis and asset holdings for each party. The overarching objective is to attain parity in asset distribution. In cases involving real estate retention, she may advise offsetting with cash to preserve equilibrium, underscoring the importance of comprehending the tax implications linked to diverse asset types. Her approach ensures that each party is left with an equitable share in the final distribution of assets.
