Non-Marital Property

If you have either non-marital or premarital property that generates income, the question of who gets the income after a divorce will depend partly on who gets that property or that asset. If it’s going to change hands, more often than not the person who receives the property in the divorce would receive the income from it. But that may be different if there’s alimony because the income from this non-marital property goes into the equation to determine whether that spouse who currently owns it will pay alimony. So that person may get the property, but pay the income out as alimony.

New Jersey family law attorney, Brad Micklin, discusses how non-marital property and income are impacted through a divorce.
