so this was this case came shortly
after uh my old partner Dave and I had
started the firm and we got this call
from an old client about her sister and
her sister’s
child uh suffocating in a in a chest
basically what we did was we were able
to get a a a you know a hold of the
police report um the police report
basically indicated that it was
negligence on the part of the parents
this happened in the inner city that
they weren’t paying attention to the
kids and um kind of poo pooed the whole
issue what we were able to do is get a
hold of the Cedar Chest uh we were able
to find out the company that
manufactured it we were then able to
hire Engineers who were able to let us
know about the latch on the Cedar Chest
when these Cedar Chest these old Cedar
chests um they were actually
manufactured by the Lane Furniture
Company uh when they would close if you
were inside that Cedar Chest you
couldn’t open them there was no release
mechanism so there were basically for
kids coffins I mean they were just
sarcophaguses and it was just terrible
and they were out there and what we were
able to do is do a research and come
across similar incidents all over the
country and in Prosecuting that case
what I was able to do was talk to other
parents it was the most tragic case that
I’ve ever done um who had suffered the
same thing basically the kids had you
know climbed in they’re playing hide-and
seek they climbed into the Cedar Chest
the Cedar Chest closes and you can’t get
out and it’s airtight and the case in St
Louis we actually ended up representing
two parents uh um two different parents
uh who had their kids uh being watched
by the father and of course there was an
old Cedar Chest the kids climbed into it
and I mean the the uh the result was was
just horrible just horrible for these
families the kids were three and five I
believe and they were playing hide-and
seek and that’s what happened talked to
a family in Ohio
um uh whose daughter um there was the
old Cedar Chest in the daughter’s room
and the daughter liked to put a pillow
in it and a you know some sort of a
cushion where she would do her homework
she would lie in the Cedar Chest and do
her homework turned over one one day
when she was in there Cedar Chest the
the lid fell she was locked in there
suffocated died absolutely horrible
um talked to another family out of
Delaware I believe where they were going
out for a a date night the mom and d uh
they had a teenage babysitter taking
care of their 5-year-old
boy um and 5-year-old boy you know
playing um hide-and seek he climbs into
the Cedar Chest it closes the babysitter
can’t find him the result is horrible
they had to remember talking to these
parents taking their depositions and
they had to actually call them out of
the movie theater where they were
watching a movie and let them know that
their son had passed uh by Suffocation
yeah it was just a just horrible but we
were able to uh you know we hired a
great uh engineering design expert who
was able to just show that there should
have been warnings that there should
have been advertisements uh letting
people know about the CH about these
Cedar chests and eventually we were able
to get notifications put in magazines
newspapers all over the place and got
them to change the way that they um
manufactured the the product so sad case
but hopefully we accomplish something
good

Kansas City, MO personal injury attorney Geordie McGonagle talks about a defect in cedar chests that poses a risk of death. He explains that the case began shortly after he and his former partner, Dave, had established their firm. They received a call from a past client about the tragic death of her sister and her sister’s child, who had suffocated in a cedar chest. The initial police report indicated negligence on the part of the parents, and the incident occurred in an inner-city setting. Authorities assumed the parents were inattentive and dismissed the case. However, the legal team decided to conduct a deeper investigation.

The team managed to obtain the cedar chest involved in the incident and traced its manufacturer to the Lane Furniture Company. Engineers were hired to examine the latch mechanism on these old cedar chests. The engineers discovered that when the chest closed, there was no way to open it from the inside—no release mechanism. Essentially, these chests acted like airtight coffins, trapping children inside and preventing them from escaping.

Through further research, the team uncovered similar incidents across the country. They gathered testimonies from other grieving parents who had experienced similar tragedies. One such case involved two parents in St. Louis, whose children, ages three and five, had been playing hide-and-seek. They climbed into an old cedar chest, and when the lid closed, they suffocated. This case was particularly heart-wrenching for the team.

Investigations revealed additional tragic stories. In Ohio, a young girl had used a cedar chest as a homework station. One day, while inside, the lid fell on her, trapping her. She suffocated and died. In Delaware, another case involved a five-year-old boy who climbed into a cedar chest while his parents were out on a date night. A teenage babysitter was unable to find him in time, and the boy suffocated. The parents learned of the tragedy while at the movies.

Despite the horrific nature of these incidents, the legal team moved forward with their lawsuit. They enlisted an engineering design expert who proved that the manufacturer should have included warnings and advertisements regarding the danger of the cedar chests. Ultimately, the team succeeded in having the manufacturer change the product design, and warnings were published in magazines and newspapers across the nation.

Though the case was tragic, the resulting changes in the product design and the public awareness campaign helped prevent further deaths, bringing some justice to the families affected by these heart-wrenching tragedies.
