I’m in the midst of litigation right now in a products liability case against Johnson& Johnson, or their subsidiary at the ___ end of surgery, which made a faulty surgical stapler. In the midst of an important part of an operation, it fired a blank, and these poor surgeons, who were excising a tumor and for which that stapler was a perfect thing to go in behind the esophagus and close off this tissue, all of a sudden had gastric content spilling and had to hand sew on this very difficult spot. My client ended up in the ICU for 10 or 11 days, was in a coma for 8 days, a ventilator, and came out of the ICU with severe PTSD and severe brain damage – 30- to 40-point drop in her IQ.

And Johnson & Johnson insists, “We could not have made a bad product,” and they are now attacking the surgeon, they’re blaming the surgeon, and a guy with impeccable credentials, also of 30-some years’ practice, and they’re attacking her. So you know, “If we can’t defend the case, we will attack the victim and we will attack the surgeon.” It’s not gonna work.
