No. Generally, just because you have a will, in the state of Minnesota and most other states, does not mean you will avoid a probate. In Minnesota, the trigger for a probate is if an individual dies and has one or more assets in that individuals name that has valued at over $75,000, or real estate of any value, then we have to probate the estate in order to retitle the assets. So a will is really just a road map for the probate court, and also for the individual’s family or the beneficiaries of those assets. A will does not in itself avoid a probate, but there are several techniques that we can assist with to avoid probates.
