NY family law attorney Russel Morgan, Esq. explains what kinds of marital agreements there are in New York and who should consider using them. He shares that in New York, there are several types of marital agreements, including prenuptial agreements, post-nuptial agreements, cohabitation agreements, and partnership agreements specifically for legal partners. He emphasizes that everyone should consider these agreements, whether for segregating assets before marriage or afterward through a post-nuptial agreement. These tools are valuable not only in the context of divorce but also for estate planning, determining what a spouse or partner may inherit. Additionally, they are essential for managing debt—especially when one partner has significant debt and the other has substantial assets—and can also serve as an effective tax planning strategy.
