we draft a lot of prenuptual agreements
for folks or we or we review them um in
Washington state uh it’s critical that
both parties have an attorney it’s
really not worth going through the
process if each party is not represented
so the typical process is an attorney
would prepare a draft of a prenuptual
agreement work with their client to make
sure that that’s what the client’s
looking for then that draft would be
provided to the uh fiance uh and their
attorney for their review that’s one of
the critical elements is is basically
representation the other aspect that’s
critical in terms of getting things done
with a prenuptual agreement is a full
disclosure of all of the assets so a
prenuptual agreement here in Washington
state is going to have a summary of both
parties assets with values and it’s
critical that there be a full disclosure
that’s something that could impede the
enforcability later if there’s not
lastly I guess the process is one that
um timeliness is is an element to it all
i won’t get involved in prenuptual
agreements that are uh basically uh
right at the gun so if we’re if we’re
you know a couple of days before
somebody’s getting married or a week or
so off it’s it’s too late in the game uh
from my perspective and we would advise
clients to do a postnuptual agreement in
that instance the last minute signings
at the rehearsal dinner just don’t come
out very well

Timeliness is also a key consideration. He does not accept prenuptial agreements drafted at the last minute, such as days before a wedding. In such situations, a postnuptial agreement is generally recommended, as last-minute signings—like those at a rehearsal dinner—are rarely effective.
