so a prenuptial agreement I think can be a
very sensitive topic for couples and I
know sometimes consider taboo I actually
encourage people to use it as a great
opportunity to talk about important uh
matters that are going to be necessary
as partnership and a marriage New York
State we consider a marriage an economic
partnership so you should be talking
about the economics and a prenuptual
agreement is designed to help the two
people in the marage decide what the
financial outcome will be in the event
of a divorce instead of the default of
New York State telling you what the law
would be and one little you know way I
try to explain it to people or a good
analogy is insurance right you don’t buy
a home hoping you’re going to need your
homeowners insurance but of course you
bought it you don’t buy a car thinking
you’re going to need your auto insurance
but of course you have it you don’t
enter a marriage thinking you’re ever
going to need the prenup but it’s an
insurance just in case to have it God
forbid the marriage doesn’t work out
Westchester, NY family law attorney Andrea B. Friedman shares her advice for people considering a prenuptial agreement.
