i think the first thing
any
prospective personal injury plaintiff
needs to
decide
is
what lawyer they want to work with and
that can be
a difficult decision i think you need to
interview the lawyer
you should
feel some chemistry with the lawyer
some confidence
you have to develop a trust relationship
that’s the most important thing
and it’s an interview process you should
ask to speak to some former clients and
see what that experience was like
dealing with the law firm you should ask
about kind of access you’ll have to the
lawyer to the lawyer’s staff
and
it takes time
lawyers need time to investigate the
facts of the case in order to prepare
the paperwork the what’s called the
pleading that they present to the court
to initiate the lawsuit
once that’s done it takes time
to get it to the whoever the defendants
are whoever you’re suing they then need
time to hire a lawyer they need time for
that lawyer to prepare a response and so
the process
of bringing a personal injury lawsuit
uh initially
can involve
some energy
once it’s going you can should be able
to rely on your lawyer to do the heavy
lifting so it shouldn’t be too much of a
burden on the plaintiff
the plaintiff
who is the client in the personal injury
case will eventually have to testify
probably in a deposition the lawyer will
prepare
the client to testify and walk them
through the process
and
attend a settlement conference if that
occurs um and then finally if it has to
go to trial
be prepared to attend the trial that in
a complex injury case that can take two
weeks or longer sometimes three or four
weeks
but by and large
the better the case the more likely it’s
going to resolve prior to trial

Austin, TX personal injury attorney Scott Hendler talks about the process of bringing a personal injury lawsuit. He believes that the first thing any prospective personal injury plaintiff needs to decide is which lawyer they want to work with, a choice that can be challenging. He emphasizes the importance of interviewing the lawyer, feeling a sense of chemistry and confidence, and establishing a trust-based relationship. He recommends speaking with former clients to understand their experiences with the firm and asking about access to the lawyer and their staff.

He notes that lawyers require time to investigate the facts of a case and prepare the initial court filings, known as pleadings, which are then served on the defendants. The defendants need time to hire counsel and respond, so the early stages of a personal injury lawsuit demand some energy from the plaintiff. Once underway, the plaintiff can rely on the lawyer to handle most of the heavy lifting.

The client will eventually need to testify, usually in a deposition, and the lawyer prepares them thoroughly for that process. They may also attend a settlement conference, and if the case proceeds to trial, the client must be ready to participate, which in complex injury cases can last two to four weeks. Ultimately, he stresses that stronger cases are more likely to resolve before reaching trial.
