so in an equal pay case where an
employee has been denied um the same pay
as other employees because of that
employees protected characteristic under
anti-discrimination laws for example
their gender or their race the employees
entitled to get the pay differential
that they were denied the additional pay
that other people of a different race or
of a different gender were getting they
can get up to an additional 200% in
liquidated damages so for example if
they were owed an additional $100,000 to
bring them even with the other employees
of a different race or gender they could
then get another $200,000 on top of that
as much as that uh up to the judge um in
liquidated damages in additional they
can get emotional damages uh in addition
they can get what are called punitive
damages and last uh they can apply to
the court once they win their case in
court to have the court order the
employer to pay their attorney’s fees

He notes that, under the law, employees may also be entitled to liquidated damages, which can amount to 200% of the pay differential. For instance, if an employee is owed $100,000 to equalize pay, they could potentially recover an additional $200,000 in liquidated damages. Beyond monetary compensation, employees may pursue emotional damages and, in some cases, punitive damages intended to punish the employer for unlawful discrimination.

Finally, he emphasizes that once a case is successfully resolved in court, the employee can petition the court to order the employer to cover attorney’s fees, ensuring that legal costs incurred while enforcing their rights can also be recovered.
