So the United States Patent Office has a number of requirements that are set forth in order to earn a patent, if you will. And so certainly it has to be the technology that’s covered has to be something for which our society says yes, we will give a patent for that type of work. And so it requires what’s known as a statutory subject matter. Another important consideration is novelty. Your idea has to be new it cannot be something found in the prior arc, something that came before us. And it has to be non-obvious, so as our understanding of technology marches forward we’re learning things and ever-expanding understanding of technology. But we want something from our applicants our government and our public is saying, our patent system is saying we want something that is sufficiently clever that we never would have came up with it but for your appearance on the horizon. And then another important consideration is it has to have some useful function, some minimal utility. So these are some of the hallmark elements that are to be satisfied in acquiring a patent.

Minneapolis patent lawyer David Black discusses what is necessary to receive a patent.
