How to Fix the Knowledge Gap

The most important thing is to have databases that are kept up-to-date that contain the knowledge that the inventors and that the attorneys need in order to both inform each other of critical knowledge. Particularly as you go forward after a patent’s filed, what we would like to see is we would like to see the corporate client or the inventor keeping the patent attorney informed as to the strategic value of the technology. So on a regular basis, maybe perhaps once a year, they would actually go in and look at the technology and rank it in terms of its importance to the company so that when the attorney picks it up two, three, or four years down the road they say, “Oh, this has got strategic value. I better make sure I spend more time on this case.” Or on the flip side, the company may mark it and say, “We’re not using this at all. We don’t plan on using it.” And then the patent attorney may pick up the phone and say, “Look, you don’t have much to go on here. I can see this is not strategic. Let’s cut our losses.”

Minneapolis patent attorney Steve Lundberg, founding shareholder of Schwegman Lundberg & Woessner explains how patent lawyers and patent clients can bridge the knowledge gap.
