He explains that, as with everything in immigration, each case is different. To succeed, one must show that the delay is unreasonable under the circumstances. If a case has only been pending for about three months, for example, it is unlikely to be considered unreasonable. However, if the case has been pending for an extraordinary length of time—much longer than what is typical for that type of case—then he can file a mandamus. Ultimately, he emphasizes, the key is demonstrating that the delay is unreasonable given the specific facts of the situation.
