Houston, TX family law attorney Rachel Sedita talks about the trends she sees in LGBTQ+ divorce. She notes that her firm has been handling LGBTQ+ divorce cases since its inception. In those early days, navigating these cases required creative approaches to work around the fact that the laws did not yet fully protect these individuals. Since the Obergefell decision, however, she has observed a strong need for education; many courts have required explanations of how LGBTQ+ status may impact divorce, child custody, and adoption cases.
Over time, she sees a clear trend toward normalization. Courts, judges, parties, and attorneys are increasingly familiar with these situations, reducing uncertainty about how cases will be handled. This shift has strengthened her ability to advise and represent clients in Texas courts effectively, providing more confident and informed guidance for LGBTQ+ families.
