Well, not only was the AUO decision, as we call it, an important decision for the state of Mississippi, it’s gonna have repercussions for every state across the country. When we took that case to the Supreme Court there were only two other circuits that had said an AG could stay in state court with their state claims; all the other circuits were uncertain about this issue and many of them hadn’t even addressed it. So what happened with this decision is it reaffirms the power that a state attorney general, who is the highest legal officer in the state, brings claims on behalf of the state and its constituents on asserting state law claims. A state court was able to make that decision.

And I think that’s what we learned in social studies as kids, that we’ve got this system of dual federalism. We’ve got the federal powers, the federal authorities and we’ve got state and this is one of the recognitions that the state sovereign has an important role in our process.

Minneapolis mass tort and complex litigation attorney Carolyn Anderson discusses how the AUO case impacts how a state Attorney General can assert claims on behalf of its citizens.
