Oftentimes people will suffer injuries, sometimes serious injuries even if they themselves have the behaved reasonably and taken care with their own safety. And in those cases, the challenge for me as a lawyer defending a public entity is to explain that the policies and procedures of my client were appropriate to minimize all the risks, taking into account the fact that cities and counties are required to provide these public services whether it’s an airport, a seaport, a county hospital, other kinds of facilities. And in my experience, when we can explain to the decision maker, whether it’s a judge or a jury, that the procedures that were followed were appropriate, that the risk of injuries were considered and taken into account in the operations and in the formulation of the policies and procedures then under the law the public entity should not be held liable. Notwithstanding the fact that sometimes people do suffer serious injuries.
