Commonly, we see the most usual mechanisms of risk transfer either via contract or through an insurance policy. What we are starting to see now is parties are negotiating the contract provisions and they are entering into risk sharing agreements. We are also seeing captive in-house counsel for insurers. But generally, what we’re seeing is not parties are trying to negotiate rather than having a lower tier party assume all of the risk or liability associated with a potential loss.
