When we talk about unlicensed source code, I’m assuming it’s unlicensed proprietary code because with open source, essentially when you utilize the code, you’re utilizing the license.  So that doesn’t, by definition, be unlicensed.  What that – the instance we’re referring to is, we have instances of where a large company’s code sneaks into open source.  So, a piece of code from Microsoft, a piece of code from IBM, a piece of code from SAP may sneak into an open source offering and not be attributed.  So, there, in essence, if you’re discovered to have been using this unlicensed code, you open yourself to a potential issue with that company’s ownership.

Minneapolis patent attorney Mark Stignani discusses using unlicensed source codes.
