Every client who comes into our office
is bringing in a personal matter and not
simply a business matter. It often
involves the estate of their parent or
of a close friend or they may have been
made a trustee by by someone who put a
lot of faith in them to carry out their
parents wishes for example. So, every
one of our cases, we prepare so that we
are ready to go to trial and to win for
the client and get the best result for
the client. But we’re also mindful that
it may not be best for our clients to go
to trial. It’s often better to try to
resolve a matter peacefully,
acknowledging that these may be
siblings, these may be family members.
In many cases, it’s better to put on the
best case we can, but also then try to
resolve it in some way that doesn’t
result in a win-loss scenario.
One piece of advice that I give my
clients is to always be mindful that
there are any number of outcomes that
could resolve this case for them. And
some of those outcomes are going to be
much better than what a court is going
to be able to give them. A court may not
have the power to play Solomon and give
something to one party and something to
another party. Trial is often a zero-
sum game. So, we certainly advise our
clients to be mindful of other ways to
resolve a case that might better serve
their interests.

For this reason, the firm counsels clients to consider alternative resolutions that may better serve their long-term interests.
