I think the primary thing that distinguishes me from other lawyers in the practice of criminal defense and specifically in the area of DWI defense is simply this: If you’re being prosecuted for a DWI, generally all the bad stuff they can do to you has happened before you’ve ever stepped foot into my office. They’ve already taken away your driver’s license. They’ve taken it away for a defined period of time. You can’t make it worse by fighting it. If you challenge a license revocation and even if you get your butt kicked in that case, what they win is exactly what they had going in. So if a license is revoked for 90 days and we lose that, they get your license for 90 days. It doesn’t get worse. So what I’ve never understood is why people don’t fight all of it. There is not a reason in the world not to fight against that charge. The same is true in the criminal area. You walk into a deal with a prosecuting attorney who says, “Jeez, you’re client’s a 0.13 and our office policy is we don’t negotiate on 0.13s. Your client can plead straight up guilty and we’ll agree today, and today only that your client won’t have to go to jail.”

Well, I will tell you that nobody’s gonna put you in jail on a first-time 0.13. So their offer isn’t an offer at all. Their offer is to ease their workload by you throwing your client on the sword. I don’t ascribe to that philosophy. I am – I work under the squeaky-wheel-gets-the-grease principle, and I go out of my way to be the squeakiest wheel that most prosecutors have ever encountered. And I’m sure most of them [laughs] will tell you I’ve achieved my lofty goal. I’m a pain in the butt. All I want a prosecutor thinking when I’m in the courthouse is, “How do I make this guy go away?” Because there’s only one way to make me go away, and that’s to give me what I want. Otherwise, we’re all gonna be spending a bunch of quality time together. So I think that’s the thing that probably distinguishes me from other lawyers is that I will actually fight these cases.
