00:04
we’ve represented a
00:06
gentleman who was 40 years old at the
00:07
time
00:09
and he got a little cut on the bottom of
00:10
his foot and he goes to the doctor
00:13
one of the you know statewide and even
00:15
nationwide big medical practices
00:17
and he wasn’t seen by a doctor he was
00:19
seen by a nurse practitioner
00:21
who to try to treat his wound put him in
00:24
a closed
00:25
boot to encase the foot keep pressure
00:28
off it and told him to come back in
00:30
five days he wasn’t actually seen by a
00:32
doctor and the doctor didn’t even sign
00:34
the note until the very next day after
00:36
the patient was already sent home with
00:38
his boot
00:39
so the patient followed instructions for
00:41
five days came back
00:43
lo and behold that little wound had
00:44
blossomed into a full-borne infection
00:47
which had gone up his leg and as a
00:50
result he unfortunately lost his leg
00:52
above the knee
00:53
and for the rest of his life has to deal
00:55
with prosthetics and
00:56
etc and through discovery we were able
00:58
to find that this doctor
01:01
never saw this patient never accessed
01:03
the medical records he just rubber
01:05
stamped this note the next day
01:07
and in fact lied about what he had done
01:09
because we deposed a computer i.t
01:11
expert who confirmed that this doctor
01:14
never went back through the chart and
01:16
looked at these medical records
01:17
he simply rubber stamped the note that
01:19
this nurse practitioner had done
01:22
and because of that misunderstanding and
01:24
really not understanding this device and
01:26
how it was to be used
01:28
the poor man lost his leg and in that
01:30
case i remember we were able to get a
01:31
1.6 million dollar settlement
01:34
to help him with his prosthetics and his
01:36
future care needs for the rest of his
01:38
life

Baltimore, MD personal injury lawyer Ruslan Kondratyuk talks about a memorable medical malpractice case involving negligence and a leg amputation. He recalls that he once represented a forty-year-old man who suffered a small cut on the bottom of his foot. The man sought treatment from a large, well-known medical practice that operated both statewide and nationally. Instead of being examined by a doctor, he was seen by a nurse practitioner, who placed his foot in a closed boot to relieve pressure and instructed him to return in five days. The supervising physician never actually examined the patient and didn’t sign off on the medical note until the following day—after the patient had already gone home.

The man followed instructions and returned five days later, only to discover that the minor wound had developed into a severe infection that had spread up his leg. Tragically, the infection required an above-the-knee amputation, leaving him dependent on prosthetics for the rest of his life.

Through discovery, the attorney and his team uncovered that the doctor had never accessed the patient’s medical records and had merely rubber-stamped the nurse practitioner’s note. Testimony from a computer I.T. expert confirmed that the doctor had not reviewed the chart or records, contradicting the doctor’s own statements.

This lack of proper oversight and misunderstanding of how the medical device should have been used led to devastating consequences for the patient. The case ultimately resulted in a $1.6 million settlement to provide for the man’s prosthetics and lifelong care needs.
