one of the forms of adr is what we call
parenting consulting other states call
parenting coordinators and a parenting
consultant in minnesota first of all has
to be agreed to by the parties it cannot
be ordered by the court without the
parties agreeing
and a parenting consultant is someone in
high conflict custody cases
who
learns about the parties and then is
able to first of all
negotiate with them just like mediation
to try and come to a resolution of
of issues and if not the
parenting consultant then makes the
decision
and that decision then is binding on the
parties
they have a certain amount of time to go
to court and say
they want to overturn that decision
generally people don’t do that so these
are for parties that are already
divorced
and have kids and are still very high
conflict and can’t agree on whether or
not it’s raining or not trust me so i do
a lot of peering consulting

St. Paul, MN family law attorney Susan Lach explains how parenting consulting works in Minnesota divorces. She pointso out that one form of ADR is what Minnesota calls parenting consulting, while other states refer to it as parenting coordination. In Minnesota, a parenting consultant can only be appointed if both parties agree; the court cannot impose one unilaterally.

A parenting consultant works with high-conflict custody cases, learning about the parties and first attempting to negotiate solutions, much like mediation. If the parties cannot reach an agreement, the consultant can make a decision on the matter, which is then binding. The parties have a limited window to challenge the decision in court, though most do not.

This process is designed for divorced parents who remain in high-conflict situations and struggle to agree on even the simplest issues. She notes that she handles a significant number of parenting consulting cases due to the intensity and frequency of these disputes.
