Everett, WA family law attorney Ken Brewe talks about how mediation works in Washington State divorce cases. He shares that in Washington State, virtually all counties require mediation before a case can proceed to trial. Mediation is often the point where meaningful progress occurs in domestic matters. Approximately 85–90% of cases are resolved through mediation rather than trial, with only a small percentage proceeding to courtroom hearings.
The mediation process typically involves the attorneys selecting a neutral third-party mediator, who may be an attorney specializing in mediation or a retired judge. Both parties submit written materials to the mediator in advance. During the session, the mediator separates the parties into different rooms and shuttles between them throughout the day, facilitating discussions and negotiation. The mediator’s role is not to decide the outcome, but to assist the parties in reaching a mutually acceptable resolution. When an agreement is reached, it is formalized in a written document reflecting the terms of the resolution.
