just because you got a marriage-based
green card doesn’t mean that you’re tied
forever
to the person who sponsored you
as we all know
marriages
can sometimes not work out and
as somebody who got a green card through
marriage you should never feel that you
must remain with somebody
only because of your legal status so
if the marriage is not working out if
you feel that your marriage is headed
for divorce or you’ve already divorced
you could still protect your residency
under many circumstances and you should
not give up on your residency just
because you got divorced

New York, NY immigration attorney Robert B. Scott explains whether or not you can lose your marriage-based green card if you get divorced. He explains that just because someone obtains a marriage-based green card does not mean they are legally bound to remain with the person who sponsored them. As we know, marriages sometimes do not work out. A green card holder should never feel compelled to stay in a marriage solely because of their legal status. If the marriage is failing or has already ended in divorce, it is still possible, under many circumstances, to protect one’s residency. Divorce does not automatically mean losing the right to remain in the United States.
