Morristown, NJ employment law attorney Claudia Reis talks about the biggest challenges faced in sexual harassment cases. She states that sexual harassment cases often present unique challenges because they are typically “he said, she said” situations. Sexual harassment rarely occurs in the presence of witnesses, as perpetrators usually act when others are not around. This lack of direct witnesses can make it difficult to corroborate a victim’s account.
However, she emphasizes that the absence of witnesses does not mean there is no evidence. She advises that employees who experience harassment should keep detailed, contemporaneous notes documenting what happened, when and where it occurred, and exactly what was said or done. Such detailed records can provide compelling and persuasive evidence in a sexual harassment case.
