With federal cases and federal charges,
the FBI, the ATF, the DEA, the Secret
Service, all of those agencies have
almost unlimited resources. They can put
an undercover agent on a client for
months and months and months at a time.
So, by the time the case is indicted or
charged, regardless of how it’s charged,
they have a pretty solid investigation
behind their case. And a lot of people
don’t understand that with federal
cases, it almost turns into a mitigation
and a sentencing memo heavy kind of
case. We take a plea, we try to work it
out in the best way we can, but the real
work comes with the judge at sentencing.
But the biggest challenge is most
definitely the investigation is so well
done most of the time and so well put
together, it’s difficult to find too
many holes in it.
Royal Oak, MI criminal defense lawyer Samuel Bennett talks about the biggest challenges faced in defending federal charges.
