Family preference immigration visas are
uh somewhat
different from
uh employment based visas. A family
member who is a US citizen can petition
for their spouse and children of course
but they can also petition for their
brother and sister. And by derivative,
because they’re petitioning for their
brother or sister, their brothers or
sister’s children can also be admitted
if they’re under the age of 21.

Miami, FL immigration attorney Ruth Jean talks about how many family members can be admitted under a family preference immigrant visa. She states that family preference immigration visas differ from employment-based visas in several ways. In this process, a U.S. citizen may petition not only for a spouse and children but also for siblings. Additionally, when a U.S. citizen petitions for a brother or sister, that sibling’s children under the age of twenty-one may also qualify for admission as derivative beneficiaries. This system allows extended family members to reunite and establish lawful residence in the United States.
