The reason they should hire me is
because I do the litigation. And by
doing the litigation, I know where these
plans go arai. And especially with our
country growing older, um the silver
tsunami, we’re going to see more and
more will contests, trust contests. So,
if you want to later in life all of a
sudden give one of your children less
than the others or maybe not benefit
your kids, benefit um friend, caregiver,
whomever, you should come to me because
I will do your plan the right way. I’m
not going to let that alleged undo
influencer have anything to do with your
preparation andor execution of the
documents. And then also I’m going to
make sure we have u a no contest
provision in there that if you
disinherit somebody the will could say
or trust can say if you dispute this you
get nothing. Well a lot of estate
planners will have that provision in
there and leave that individual nothing.
Well they have nothing to lose because
you haven’t left them anything. So when
a client comes to me and they say you
know what I don’t want to give this kid
anything or I want to give them less
than I give my other children. I say to
them, well, how much could you give them
so that it it’s not they won’t contest
it, you know? So, in some scenarios, it
might be, well, give this, you know,
child $20,000, $50,000 more if you’ve
got more money, but you want to give
that person enough money so that they’re
not going to risk losing that money uh
when they contest the will because a lot
of practitioners will have a no contest
provision in their documents, but then
that child they’re disinheriting
inherits nothing anyway. So, there’s no
deterrent to go file a lawsuit and
contest the document. And and even with
some of the business work I do, I
because I do the litigation, I know how
those documents should be written up.
