He explains that most individuals require a formal document to articulate their wishes. The most common option is a will, though a trust can also serve as an alternative. These instruments form the foundation of estate planning.

Beyond that, he emphasizes the importance of what he calls “planning for the living.” This includes establishing a health care power of attorney to designate someone to make medical decisions if the individual becomes incapacitated. Similarly, a statutory durable power of attorney is used to authorize someone to handle financial and other non-health-related decisions, essentially covering all actions the individual could take if fully capable.

For clients with minor children, he advises executing a guardianship document to name a guardian in the event the parents become unable to care for their children. Additionally, he routinely reviews beneficiary designations to ensure they align with the client’s will or trust, ensuring that assets pass to the intended recipients in accordance with the client’s wishes.
