one of the
00:05
more memorable bedsore cases that i
00:08
handled was one of the
00:09
first cases that i actually handled
00:12
this case stood out because this
00:14
gentleman
00:15
was in good health he was in his mid 80s
00:19
unfortunately he was in a car accident
00:21
and
00:22
the idea was okay you need to get your
00:25
strength back we’re going to put you in
00:26
this nursing home for 30 days
00:29
and then you’ll be back home with your
00:31
wife and grandchildren
00:32
well unfortunately for him at this
00:34
nursing home
00:36
after about two weeks they moved him
00:39
from one wing of the facility to another
00:41
wing
00:42
and we noticed this in the records that
00:45
once
00:46
our client was moved to the other wing
00:48
there were no longer any daily
00:51
entries for his care what care was being
00:53
provided how he was doing
00:56
and then about two weeks later the
00:58
entries start again and it says
01:00
he has a stage three pressure ulcer
01:02
which is a very serious pressure ulcer
01:05
and then the next day it’s stage four so
01:07
we went from having
01:09
perfect skin upon admission to the
01:12
nursing home and for the first two weeks
01:14
according to the notes
01:16
then we have no notes for two weeks and
01:19
then once they start taking
01:20
notes again the nursing notes and the
01:22
medical records we
01:24
see that he has a stage three and then a
01:26
stage four pressure ulcer
01:28
then he developed sepsis and then he
01:31
died
01:32
so it’s memorable to me because this
01:35
gentleman
01:36
if they just provided the proper care
01:38
and not completely neglected him for two
01:40
weeks
01:42
would have been alive and well in home
01:44
enjoying his golden years with his wife
01:46
and
01:47
children and grandchildren that case we
01:50
we took many depositions we were about
01:53
30 days prior to trial
01:54
and the court ordered us to mediate the
01:58
case
01:59
and so at the initial mediation it did
02:01
not settle
02:03
but about a week before trial the
02:05
defendant reached out
02:07
they improved their settlement offered
02:09
dramatically
02:11
and my clients accepted that so it was
02:13
resolved just short of trial
