So, when you’re charged with a DUI, the
DMV uh can take action on your license
separate and apart from any criminal
case. Uh the criminal case obviously it
can have an impact on whether you are
able to drive. Um but the DMV often
actually will take a separate action
from that. Now, we we help with that. Um
we represent our clients both on the DMV
side as well as on the criminal side.
So, the DMV will have an independent
hearing. Um and oftentimes a license can
be taken at that hearing. Um depending
on the outcome of the criminal case, it
can also uh your license can also be
revoked in that situation. In order to
get your license back, often times the
DMV will require certain things. They’ll
require uh classes for you to take. Um
they’ll require certain affidavit and
often times breathalyzer device will be
required to be installed in your vehicle
before you can get your full license
back.

Colorado Springs, CO criminal defense attorney Gannon Becker talks about what happens to your driver’s license if you’re charged with a DUI. He notes that when an individual is charged with a DUI in Colorado, the DMV may take independent action regarding the person’s driver’s license, separate from the criminal proceedings. While the outcome of the criminal case can influence driving privileges, the DMV conducts its own hearing to determine whether a license suspension or revocation is warranted.

He represents clients in both DMV administrative proceedings and criminal cases, ensuring a comprehensive approach to protecting their rights. Depending on the hearing’s outcome, the DMV may impose requirements before reinstating a license. These often include completing DUI education or treatment programs, submitting affidavits, and, in many cases, installing a breathalyzer interlock device in the vehicle prior to obtaining full driving privileges.
