So, the possible penalties for a first,
second, and third DUI are all similar.
They’re similar in the sense that they
are all misdemeanors. Um, for first
offense DUI, um, there’s a possibility
of anywhere from 12 to 24 months of
probation. For a second and third
offense DUI, that goes up a little bit.
That goes uh to tw uh two to four years
of probation. Um, as part of that, uh,
there’s certain requirements, uh, such
as an alcohol evaluation. You have to do
an alcohol evaluation and, uh, comply
with all those requirements. The
requirements are things like taking
alcohol education courses. Um, that’s
going to be 2 hours a week for multiple
weeks. And then after that, there’s um,
alcohol therapy. Um, sometimes you have
to do a victim impact panel as part of
it. There’s community service. Possible
penalties for a first offense DUI are
anywhere from 5 days to one year in
jail. Um, unless your blood alcohol
content is over a point 2, in which case
there’s a mandatory 10 days jail. A
second offense DUI comes with the
possibility of 10 days to one year in
the county jail. And a third offense DUI
comes with 60 days to one year in the
county jail. General conditions of
probation for a DUI are going to involve
um it can either be supervised or
unsupervised probation. Uh for
unsupervised probation, basically what
that means is that it’s up to you. It’s
your you are in charge of making sure
that your requirements are all complied
with uh that they’re filed with the
court and you’re doing what you need to
do. Um when you have supervised
probation, uh that’s actually checking
in with the probation officer. Sometimes
it’s in person. Uh other times it’s just
phone call check-ins, things like that.
And the probation officer is is uh
somebody who can actually help you get
those things done and make sure that
you’re complying with all your
conditions to be successful on
probation.
