yeah so here’s one I had and you know I
don’t do that many DUIs in my life
especially when I was younger I’ve
overall done thousands of them but it’s
not my main focus but I probably do a
few a year there are people who make it
their whole business to know DUIs and
that’s really not me and they’re good
you know so sometimes I refer that a way
I I mostly do bigger cases however I did
have a really interesting one this year
the a guy was in a park sleeping in his
car having been drinking at the park his
car’s off he’s asleep but the park is
closed so the police pull in blare at
him through the loudspeaker to leave the
park flashing lights eventually he wakes
up gets out of the back seat he doesn’t
know what’s going on all he sees is
these lights being speaker yelling at
him it’s cops he gets in his car starts
driving kind of badly and slowly and
gets pulled over for a DUI you know the
defense there was that he was acting
upon Public Authority to drive he wasn’t
going to drive he was going to sleep
there which is also against the law but
that’s more like trespassing we raised
that issue and ended up losing it which
and I’m still fighting that case
actually on appeal too on the grounds
that you know what’s this guy supposed
to do when you’re being ordered under
you know the pain of basically thwarting
or arguing with the police at 1:30 in
the morning at night which we all know
is not the right thing to do it’s not
what we’re taught to do especially these
days it’s dangerous so he did what they
said and then got the DUI and I think
that was wrong

He recalls a particularly interesting DUI case from earlier this year. The client had been sleeping in his car at a park after drinking. Although the car was turned off, the park was closed, and police officers arrived, using a loudspeaker and flashing lights to order him to leave. Confused and complying with the officers’ instructions, the client got into his car and began driving slowly, which led to his being pulled over and charged with a DUI.

The defense argued that the client was acting under public authority, responding to the officers’ instructions, rather than intending to drive. While the court did not accept this argument, he is currently pursuing an appeal, contending that the client’s actions were a reasonable response to law enforcement directions late at night. He views the case as an example of the challenges individuals can face when caught in unexpected and high-pressure situations, and believes the initial outcome was unjust.
