sure I had a uh drug
case uh last year where my client uh who
was an African-American individual
driving a nice car was pulled over by
the police Downtown Minneapolis for
supposedly running a red light which he
didn’t do but they um went up to his car
and stated that they could smell
marijuana and noticed uh according to
them marijuana flakes uh on the on the
seat of the car now my client didn’t
smoke marijuana he doesn’t smell
marijuana the car didn’t smell like
marijuana because there was no marijuana
in the car so they get him out of the
car they arrest him they bring him down
to the police station and they find a
gun and a bunch of cocaine which of
course uh anyone knows is a mandatory
minimum sentence in the state of
Minnesota we went to a an omnibus
hearing where I moved to suppress all
the evidence because the search was
illegal and it was based on false
information uh alleged by the three uh
police officers I sequestered all the
witness Witnesses in the case and uh
cross-examined them separately so they
couldn’t hear each other’s testimony the
judge issued an order finding that uh
the police officers testimony was
suspect and dropped all charges against
my client he walked free

He recounts a recent drug case involving an African-American client who was stopped by police in downtown Minneapolis under the pretext of running a red light, an infraction he did not commit. Officers claimed they smelled marijuana and observed what they described as marijuana flakes on the car seat. In reality, the client did not smoke marijuana, the vehicle had no odor, and no marijuana was present.

Despite this, the officers removed him from the vehicle, arrested him, and transported him to the police station, where they discovered a firearm and cocaine—offenses carrying mandatory minimum sentences in Minnesota. At the omnibus hearing, he moved to suppress the evidence on the grounds that the search was unlawful and based on false assertions by the officers. He sequestered the witnesses and cross-examined them individually to prevent coordination of testimony. The judge ultimately found the officers’ testimony unreliable and dismissed all charges, allowing his client to walk free.
