Colorado Springs, CO criminal defense attorney Zoe Levesque talks about the possible defenses that might be available in domestic violence cases. She explains that several defenses may be available in a domestic violence case. One common defense is self-defense, which requires demonstrating that the defendant faced imminent danger and that the force used was reasonable under the circumstances. Another defense is the defense of others, applicable when the defendant used a reasonable amount of force to protect someone else who was in imminent danger. A third defense is the “choice of evils” doctrine, which applies when the defendant acted to prevent a greater harm or avoid a more serious outcome, even if their actions caused a lesser harm.
