So in Colorado, domestic violence is
defined as an act or threaten act of
violence upon a person whom the actor is
or has been involved in an intimate
relationship with where the act of
violence is used to gain or maintain
power and control over the other person.
It’s important to note that domestic
violence is not just a crime in itself,
but it’s rather a sentence enhancer
which can be tacked on to any other
underlying crime. For example, um let’s
say you were to steal something from
your fiance. Um it’d be a domestic
violence theft. So the criminal charge
is theft, but you’re also charged with
domestic violence due to the fact that
the person you’re in in intimate
relationship with is your fiance.

Colorado Springs, CO criminal defense attorney Zoe Levesque talks about domestic violence in Colorado. She explains that in Colorado, domestic violence is defined as an act or threatened act of violence against a person with whom the perpetrator is or has been in an intimate relationship, where the violence is used to gain or maintain power and control over the other person. She emphasizes that domestic violence is not only a standalone crime but can also serve as a sentence enhancer, applied in conjunction with other underlying offenses. For example, if an individual commits theft against a fiancé, the criminal charge would be theft, but it would also carry a domestic violence enhancement due to the intimate relationship between the parties.
