I think a lot of times when we think
about domestic violence cases we sort of
think about the prototypical spouse
beating on another spouse or a boyfriend
or girlfriend beating up the other
person but that’s not always how these
go for example there are cases where
perhaps there’s an argument sometimes
there’s a mutual fight between people
the police are called to try to diffuse
a situation and the police end up making
a charging decision and they charge
someone with a crime even though the
witness doesn’t want anyone charged and
so these sorts of cases we really uh
take a hard look at in terms of making
sure that our client’s interest is is
represented fully whether that be the
person defending from the crime or the
witness of the crime but these aren’t
always straightforward cases

Manassas, VA criminal defense attorney Lili R. O’Connell talks about how she approaches a client whose spouse faces domestic violence charges but does not want to proceed. She explains that domestic violence cases are often more complex than the typical scenario of one partner physically assaulting another. Some cases involve arguments or mutual altercations, where police are called simply to diffuse the situation. In these instances, law enforcement may make a charging decision even if the parties involved do not wish for anyone to be charged.

She emphasizes that her firm carefully evaluates each case to ensure that the client’s interests are fully represented, whether the client is the person charged with the offense or a witness. She notes that domestic violence cases are not always straightforward and require thoughtful assessment and strategy to protect her clients effectively.
