So, a dissolution proceeding is
initiated when one party files a
petition that then gets served on the
other spouse and they will file
hopefully a response to the petition.
That’s what really gets the action
started. From there, both spouses are
required to serve and exchange what we
call preliminary declarations of
disclosure. that includes um all of
their assets and debts as well as
details their income. After that’s done,
there are really two different tracks
that the divorce process can take. Uh if
the parties are interested in resolving
quickly, um we can go the settlement
route and get into some type of
mediation or voluntary settlement
conference and try to resolve all of the
issues without having to litigate in
court. However, that’s not the reality
for all cases. And so the other track
available is that you are filing various
what we call requests for orders with
the court seeking relief. This can be
for child support, child custody,
spousal support, attorney’s fees, and a
variety of other issues. If the case
requires litigation, then it is resolved
ultimately by going to trial.
