The first step he takes is submitting a letter of representation along with a request for discovery, ensuring he receives every piece of evidence the prosecution intends to use.
He emphasizes that the burden of proof lies with the state—the defendant does not have to prove innocence. For instance, if a client is accused of possessing cocaine, the white powder in question must be sent to a lab, and he must see the lab report confirming it is actually cocaine. If the report comes back negative, he will immediately file a motion to dismiss the case. He believes this method is the most effective and consistently achieves the best results for his clients.
