well in my experience in doing this just
shy at 25 years I’ve had a I can’t tell
you how many people I’ve heard say you
know this is gonna be an uncontested
divorce and I can probably count on one
hand the number of those that truly were
uncontested so so that’s one reason
right there because a lot of the time
people just you know people say that and
they don’t understand all the different
issues that come up and that’s the same
reason that you you know you want a
lawyer because a lot there are certain
forms that people can find out there
okay
but those forms generally are not going
to contain all of the information that
you need so let’s say you can put
together a decree you can put together a
wage withholding order to take care of
child support issues do you have a form
that is going to deal with how you are
going to split oil and gas royalties out
there do you have the particular
qualified domestic relations order that
is going to split the 401k however you
decide to split it without creating a
taxable event you know you probably do
not and you need some advice from a
lawyer on here’s what you need to watch
out for I mean I have heard the horror
stories of you know a $1,000,000
retirement account that Joe Blow turns
around and strokes a check for half a
million dollars to is you know now
ex-wife well that’s a taxable event she
just gave away about a quarter of a
million dollars you know that’s not a
good situation you don’t want to place
yourself in that situation the problem
is unless you deal with it all the time
you don’t even know and that’s why you
need to hire a lawyer you don’t know
what you don’t know and it really is not
nearly as painful in hiring a lawyer as
it is on the back end when you’re
throwing your hands up saying oh my god
this is a mess I need help please get me
out of it much easier to plan from the
beginning than to try to get you out of
it in the end

Dallas high-net-worth divorce attorney, Mark Scroggins, talks about why you should get a lawyer, even if the divorce will be non-contested. He reflects on his 25 years of experience and notes that nearly every divorce initially labeled “uncontested” ends up being more complicated than clients expect. In his experience, he can count on one hand the cases that truly were uncontested. Many people simply underestimate the variety of issues that arise.

He emphasizes the importance of hiring a lawyer because standard forms, even those found online, rarely cover all necessary details. For instance, while a form might help draft a basic divorce decree or wage-withholding order for child support, it won’t address complex matters like splitting oil and gas royalties or crafting a qualified domestic relations order to divide a 401(k) without triggering a taxable event. Without proper guidance, clients can unintentionally create costly mistakes—he recalls cases where someone gave away hundreds of thousands of dollars in taxes simply by mishandling retirement account distributions.

He stresses that most people don’t know what they don’t know. Engaging a lawyer from the outset is far less painful and risky than trying to fix mistakes later. Proper planning at the beginning can prevent significant financial and legal headaches down the road.
