He explains that construction litigation often involves a wide range of issues. Some stem from design flaws—situations where architects or engineers create plans that cannot realistically be built in the field. Other disputes may arise over changes, bonding, liens, payment claims, or specific contract terms.
He stresses that one of the most significant challenges in construction cases lies within the terms of the construction contract itself. He always advises clients to have him review the contract before signing, as many agreements are heavily one-sided and unfavorable. Being on the wrong side of such a contract, he warns, is like starting six feet underground—an extremely difficult position from which to recover.
