i have handled many
memorable cases in my over 40 years of
practice.
i have participated in lengthy trials in
construction cases.
i’ve handled numerous appeals in
construction cases
and appeals in both state and federal
appellate courts.
it’s gratifying to be able to cite a
published case
that i have argued and use it
successfully
in a subsequent litigation. recently
we were able to assist
trial counsel or we actually were
engaged to monitor trial
counsel in a two-week construction case
in montgomery county. it was a hotly
contested case
and we were engaged not only to moderate
the case but to
handle an appeal if that became
necessary. unfortunately,
the trial resulted in a seven million
dollar judgment against our client.
our firm then went on to take over the
handling of the case.
we took the case to the court of special
appeals of maryland
and then to the court of appeals of
maryland, resulting in the complete
reversal of that seven million dollar
verdict against our
client, while at the same time handling
a complicated legal issue of first
impression
that assisted the court of appeals of
maryland
in interpreting the uniform contribution
among tort feasers act.

one other thing i’d like to talk about
in
the field of complex construction cases
is the satisfaction that
we bring our clients. we have many
construction clients that come back to
us
to assist with later matters, and one
in particular
i am very fond of because, as a result
of a 2002
construction accident that caused the
death
of three people and injuries to others,
i had the privilege of representing a
general contractor
and the president of that company, who
was a really stand-up guy.
we negotiated all of those claims
over a period of about a year and a half
and settled every one of them
without any lawsuits being filed. we were
very proud of that outcome
and that result, and my client calls me
every year for the past 15 years
on the date of that accident and thanks
me for saving his company.

The efforts resulted in the complete reversal of the verdict, while simultaneously addressing a complex legal issue of first impression that aided the Court of Appeals in interpreting the Uniform Contribution Among Tortfeasors Act.

In complex construction cases, he takes particular satisfaction in the outcomes delivered to clients. Many construction clients return to the firm for ongoing matters. One case of note involved a 2002 construction accident that caused the deaths of three individuals and injuries to others. He had the privilege of representing the general contractor and the company president, negotiating all claims over approximately 18 months and settling every matter without litigation. This outcome was a source of pride, and to this day, the client calls annually on the anniversary of the accident to express gratitude for protecting the company.
