Well, the family code is clear that both
parents have an obligation to support
their children and they should do so
according to that parents ability.
However, uh the determination as to
which parent will be the one paying
child support is primarily based on the
respective gross incomes of each party
as well as the custodial time share of
their minor children. For instance, if a
parent only has a five or 10% time share
of the children, their support
obligation will be higher as compared to
if they shared custody on an equal basis
with a 50/50 time share. By the same
token, if you know only one parent works
as opposed to both parents, then the
child support obligation will be higher
as opposed to there being two incomes
taken into consideration in the
guideline child support calculation.
