In every relocation there is going to be a parent who is supposedly gonna be left behind and it’s important that they have an opportunity to be able to make their case to the court if they think that it really needs to be stopped. The one thing that they really can’t do is to stop the parent from moving which is the first thought of a lot of the parents who are posing relocation. The courts are required to assume that they’re gonna move ’cause otherwise it’s not really fair to them, to that parent, if you don’t start with that presumption.

But having said that, what the court can do is to change custody to keep the children in their current environment, in their current city. That’s what it’s all about and you need to bring a lot of facts to bear. There’s usually a big investigation by a Guardian Ad Litem or some kind of psychologist to determine what’s in the children’s best interests and that’s a critical part that we have to focus on.
